Terms and Conditions
These are the general terms and conditions of Classy Pilates GbR, hereinafter referred to as Classy Pilates.
A: General
Price Categories:
You conclude your membership for the use of a specific price category. Information about our price categories can be found in your clubs.
1) Your Account
To access the full features of the website www.classypilates.de, you must create your own online account. Under no circumstances may you use another person’s personal account without permission. You alone are responsible for maintaining the confidentiality of your account and password. You are responsible for ensuring that your password remains confidential and securely stored; insofar as user data is obtained from our sphere by a third party without your authorization, we (Classy Pilates) shall be liable. You should notify us immediately of any breach of security or unauthorized use of your account.
Please verify the accuracy and completeness of your information before submitting it. You must notify us of any changes.
We reserve the right to deny you services on our website and close member accounts in justified cases. This applies in particular if you violate applicable law, contractual agreements, and/or our house rules.
2) Studio Usage, Booking System, Rules of Use and House Rules
Through your member account, you may book any classes available in our fitness studios during the scheduled class times. Attendance at a class is only possible with prior registration. If a class is already fully booked, you may join the waiting list. A spot will become available to you as soon as another participant cancels.
Training sessions and classes must be canceled at least 12 hours in advance. Cancellations made later cannot be accepted. Refunds are no longer possible in such cases. After this deadline, or in the event of a no-show, the booked class will still be deducted from your class balance unless a third party agrees to participate at short notice.
You should arrive in your class room 10 minutes before the start of training. If you arrive later, your spot may already have been given to a member on the waiting list. In such cases, the class will not be charged.
Participants attending a training session/class for the first time should arrive in the class room 15 minutes before the start of training. Trainers will provide an introduction to the training and class process before the class begins.
We reserve the right to cancel classes at short notice and to change schedules and/or trainers. If there are fewer than five participants, we reserve the right not to hold the class. Registered participants will be informed of cancellations by email at least 10 hours in advance. The canceled session will be credited back to the participants.
No classes take place between December 24 and January 2. Furthermore, we reserve the right to close on all public holidays and for up to 9 days per year due to renovation work or other urgent operational requirements without entitling members to claim refunds. Dates will be announced in advance via notice and/or email.
House Rules
- Please inform your trainer before each training session of any injuries, health issues, or physical limitations. The trainer will inform you whether participation in the class is safely possible and under what conditions.
- Towels are required during training. We provide one towel per training session. After training, towels must be placed in the designated containers. Towels remain the property of Classy Pilates.
- Do not deviate from your trainer’s instructions. Incorrect or deviating execution of exercises poses a risk of injury.
- Always bring your treadmill to a complete stop before stepping off the machine.
- Do not place objects such as weights or similar items on the treadmill.
- All equipment used during training must be returned to its designated place after the training session.
3) Availability
We always strive to ensure that the Classy Pilates service is available to you without interruption and that transmissions are error-free. However, due to the nature of the internet, this cannot be guaranteed. Your access to the Classy Pilates service may occasionally be interrupted or restricted to allow for repairs, maintenance, or the introduction of new services. We attempt to minimize the duration of any such temporary interruptions or restrictions.
4) Photo, Film and Webcam Recordings
The creation of photo, film, and webcam recordings for commercial purposes within the premises of Classy Pilates fitness studios is only permitted with prior authorization from Classy Pilates. Classy Pilates GbR reserves the right to assert claims for damages in the event of non-compliance.
5) Copyright
The content, logos, graphics, works, etc. contained on the website are subject to German copyright law. Reproduction, editing, distribution, and any type of use beyond the limits of copyright law require the written consent of the respective author or creator. Downloads and copies of this page are permitted only for private, non-commercial use. Insofar as the content on this page was not created by the operator, third-party copyrights are respected. Should you nevertheless become aware of a copyright infringement, please notify us accordingly. Upon becoming aware of legal violations, we will remove such content immediately.
6) Data Protection
Classy Pilates collects, stores, processes, and uses personal data that we receive directly from you or through the use of our facilities and website. Classy Pilates uses this information about you to manage the customer relationship and offer you additional products and services. Only Classy Pilates has access to the stored data. Further information, especially regarding the right of withdrawal, can be found in our privacy policy.
7) Third-Party Websites
Our website may contain links to third-party websites that are not owned or controlled by Classy Pilates GbR.
Classy Pilates GbR has no control over and assumes no responsibility for the content, privacy policies, or practices of third-party websites or services. We strongly recommend that you read the terms and conditions and privacy policies of any third-party websites you visit.
8) Minors
If you are under 18 years old, you may only use the website www.classyfitness.de with the involvement of a parent or legal guardian. Our products and tickets may only be purchased by adults. We do not offer products or tickets for purchase by minors.
9) Limitation of Liability
Classy Pilates is generally not liable for damages suffered by class participants. This does not apply to liability for breach of an essential contractual obligation or for damages resulting from injury to life, body, or health, nor for damages caused by intentional or grossly negligent breach of duty by Classy Pilates, its legal representatives, or agents. Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible and on whose compliance the contractual partner may regularly rely. An essential contractual obligation of Classy Pilates includes, in particular but not exclusively, the continuous provision of various fitness classes.
Participants are expressly advised not to bring valuables into a Classy Pilates fitness studio. Classy Pilates assumes no duty of supervision or care for valuables brought into the premises. Depositing money or valuables in a lockable locker provided by Classy Pilates does not create any obligations on the part of Classy Pilates with respect to the deposited items.
B: Special Conditions/Notes Regarding Tickets/Cards, Classy Packages and Opening Offers Available on Our Website
1) Offer and Conclusion of Contract for Cards/Tickets and Classy Packages
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit offers for the conclusion of a purchase contract regarding the displayed goods. Errors excepted.
By clicking the “Buy Now” button in the final step of the ordering process, you submit a binding offer to purchase the cards/tickets/Classy packages. The purchase contract is concluded when we accept your order through a confirmation email immediately after receiving your order. The confirmation will also be displayed at the end of your ordering process on the website.
To enter into a valid contract with Classy Pilates, you must be at least 18 years old.
2) Payment
Payment is made by credit card unless another payment method has been agreed upon. If an amount cannot be debited due to insufficient funds at the time of booking, resulting in a returned direct debit, a returned debit fee of €10.00 will be charged for each occurrence.
3) Right of Withdrawal Instruction
Consumers have the following right of withdrawal, whereby a consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract or receipt of a proper withdrawal instruction.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no event will you incur any fees as a result of the reimbursement.
If you requested that services begin during the withdrawal period, you must pay us an appropriate amount corresponding to the proportion of services already provided up to the time you informed us of the exercise of your right of withdrawal in comparison to the total scope of the services provided for in the contract.

4) Transferability of Purchased Classy Packages
All card types may be transferred/shared. The new user must create a new personal account to use the services of Classy Pilates.
5) Validity Period of Classy Packages
Single cards are valid for 30 days. 5-class cards are valid for 90 days. 10-class cards expire after six months. 20-class cards expire after 9 months. 30-class cards expire after 12 months. After the expiration date, redemption of individual cards/tickets is no longer possible.
6) Term and Termination of Classy Pilates Memberships
Classy Pilates memberships have a minimum term of one month, six months, or twelve months. During this period, termination without important reason is excluded.
All offered Classy Pilates memberships are automatically extended by the previously agreed minimum term after expiration of the minimum term. Memberships must be canceled no later than the third working day of a month effective at the end of that month. The notice period for one-month memberships must be observed before expiration of the minimum term.
Termination by the Member
(1) You are entitled to extraordinary termination under the following circumstances in particular:
- In the event of pregnancy.
- In the event of illness making continued use of our services impossible or harmful. Extraordinary termination is excluded if use of individual, not entirely insignificant parts (e.g. course offerings or individual equipment groups) remains possible.
- If you relocate your primary residence to a place more than 50 km from the Classy Pilates fitness studio.
- If the Classy Pilates fitness studio closes or relocates and the new location is at least 30 km farther from your primary residence than the previous location.
(2) In the cases of paragraph 1 no. 1 and 2, termination only becomes effective if, in addition to the notice of termination, an original medical certificate from an independent specialist confirming the illness or pregnancy is submitted to us. In the case of termination under paragraph 1 no. 3, proof of deregistration and registration of residence must be submitted with the notice of termination.
(3) Any termination by you, regardless of reason, must be sent to us, Classy Pilates, Wilhelm-Leuschner-Straße 38, 60329 Frankfurt am Main, in original form by post. Terminations in oral, telephone, or electronic form are expressly excluded. Termination by fax is not effective.
Rights of Termination by Classy Pilates
(1) If you are in arrears with payment of an amount equal to two monthly fees, we are entitled to terminate the contract without notice for good cause.
(2) Termination for other important reasons remains unaffected.
(3) In the event of termination for important reason, we expressly reserve the right to assert claims for damages against you in accordance with statutory regulations.
C: Special Conditions/Notes Regarding Goods Available on Our Website (e.g. Sweatshirts)
1) Offer and Conclusion of Contract for Products (Sweatshirts etc.)
The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to submit offers for the conclusion of a purchase contract regarding the displayed goods. It is a non-binding online catalog. Errors excepted.
Orders can only be fulfilled while supplies last and only become effective after confirmation of the order price. Minor color deviations in goods displayed on the website are technically unavoidable.
To enter into a valid contract with Classy Pilates, you must be at least 18 years old.
If your order is accepted, we will notify you by email. By placing an order, you confirm that all information provided by you is correct and accurate, that you are an authorized user of the credit card used for the order, and that the account has sufficient funds to cover the cost of the goods. Changes to advertised prices are reserved.
This email merely confirms receipt and does not yet constitute acceptance of your order. A contract is only concluded when we confirm by email that the goods ordered by you have been dispatched to you. Only the goods listed in the confirmation email sent at the time of dispatch form part of the contract.
2) Right of Withdrawal Instruction
Consumers have the following right of withdrawal, whereby a consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the goods.
